Payment Terms

Our collection services are typically provided on a contingency fee basis, meaning we are compensated only when we successfully collect on your accounts. Specific terms include:

• Commission rates are determined by account type, age, and complexity
• Fees are deducted from collected amounts before remittance
• No upfront fees or monthly charges for standard collection services
• Additional services may incur separate fees as agreed upon
• Payments to clients are made according to agreed schedules

Intellectual Property

The American Resolution Service website and its content, including but not limited to text, graphics, logos, images, and software, are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without written permission
• Use our trademarks or logos without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our content

Disclaimers and Limitations

Limitation of Liability

To the maximum extent permitted by law, American Resolution Service shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Our total liability shall not exceed the fees paid by the client for the specific services that gave rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless American Resolution Service from and against all claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

Either party may terminate our services agreement with written notice. Upon termination:

• We will cease active collection efforts on your accounts
• Accounts in progress may be returned to you
• Final accounting and payment will be provided
• Confidentiality obligations will survive termination
• You remain responsible for fees on collected amounts

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation, if negotiation fails
3. Binding arbitration in Orange County, California

Our services are conducted in compliance with applicable laws and regulations, including:
